What Is a Garden Suite?

A garden suite (also called an Additional Dwelling Unit, or ADU) is a self-contained residential unit — complete with its own entrance, kitchen, and bathroom — built detached from your main home in the rear yard. It cannot be severed from the main property or sold independently, but it can be rented out long-term or used as a private space for family members.

Garden suites are distinct from basement apartments, which are interior secondary suites. They’re freestanding structures, and that distinction matters for both design possibilities and the permit process.

How Ontario’s Bill 23 Changed Everything

Ontario’s More Homes Built Faster Act, 2022 (Bill 23), together with Ontario Regulation 462/24 (in force since November 2024), transformed what’s permitted on residential lots across the province. The key change: most urban residential lots can now have up to three units as-of-right — meaning no rezoning or Committee of Adjustment application is required in most cases.

For a typical Oakville homeowner, that means you can have:

  • Your primary home
  • A basement or interior secondary suite
  • One detached garden suite in the rear yard

This as-of-right permission removed the single biggest barrier that previously stopped many homeowners from proceeding. You still need a building permit — but the path is far cleaner than it was just a few years ago.

Oakville’s Specific Zoning Rules (2026)

Oakville governs garden suites through its Zoning By-law 2014-014 (as amended), aligned with the provincial framework. Here are the key parameters:

Eligible Zones

R1, R2, and R3 residential zones — which covers the vast majority of Oakville’s established neighbourhoods.

Minimum Lot Requirements

Your lot must have at least 15 metres of frontage and 465 square metres of total area.

Size & Height

  • Maximum building size: 100 square metres (roughly 1,076 sq ft) — enough space for a well-designed one- or two-bedroom unit
  • Maximum height: 6 metres, generally allowing up to a 1.5-storey structure with a loft

Setback Requirements

  • 0.6 metres from the rear lot line
  • 0.9 metres from interior side lot lines
  • 3 metres from a flankage street on corner lots

Lot Coverage & Parking

  • All buildings combined cannot exceed 40% of total lot area
  • One parking space must be retained for the main dwelling; no additional parking is required for the garden suite

Important exception: Garden suites are not permitted in Oakville’s Lakeshore Character Areas or the Old Oakville Heritage Conservation District without a successful variance from the Committee of Adjustment. Always confirm current zoning requirements with the Town of Oakville’s Planning department before proceeding.
