Every custom home application in Oakville now gets the same comment from the Town’s development engineering department. Show us how you will keep your rain on your own lot. It sounds simple. In practice, it shapes your grading plan and your landscaping budget. Sometimes it even decides whether your basement walkout survives design review.

This is part two of our servicing series — part one covered water and sanitary connections and what they cost. This guide covers the water that falls from the sky. We explain Oakville’s 25 mm retention rule, the systems that satisfy it, and the soil tests behind them. We also cover the Town’s grading standards and the cases where Conservation Halton joins the approval chain.

The 25 mm rule, in plain language

Oakville’s Development Engineering Procedures and Guidelines (s. 7.3.1) set the standard. Your lot must retain — and ideally infiltrate — the runoff from a 25 mm rain event. The rule counts all site areas: rooftop, driveways and hardscape, and the lawn itself. Tear down a bungalow and replace it with a much larger home and more paving, and the lot sheds more water, faster. The Town’s answer: each infill lot must hold the first inch of rain. It cannot push that water at the neighbours or an already-busy storm sewer.

On most single-lot builds the practical answer is a soakaway pit or dry well: an underground gallery of washed clear stone (30–40% void space). It accepts roof and surface water and lets it soak into the ground over a day or two. The Town enforces the details, too. Every dry well needs an inlet (a catch basin), and systems over 8 m² need two. The Town also expects cleanouts for maintenance and discourages storage deeper than about 1.5 m.

The soil decides the design

Infiltration only works where the ground accepts water. Your engineer will order a percolation test to confirm three things. First, the soil’s permeability. Second, that the system can drain down within 48 hours. Third, that seasonal high groundwater and bedrock sit at least 1.0 m below the bottom of the system.

Only about a third of Oakville has sandy, infiltration-friendly soils. On clay and silt lots — common across much of town — you still have to capture and control the 25 mm volume. The difference: the system releases it slowly to the storm sewer or roadside ditch. Where a downstream sewer surcharges, the Town tightens the release rate further. Same rule, very different system — and the soils report tells you which lot you own.

Downspouts, sump pumps and the rules people trip on

The Town’s standard is blunt: all downspouts discharge onto approved sodded areas over splash pads. You do not get to hard-pipe the roof leaders underground straight into your storm system. The lawn is part of the design. Foundation drains connect to the storm sewer where one exists. On ditch-drained streets, your engineer works the sump discharge into the grading plan. Otherwise it simply reappears in the neighbour’s side yard.

Grading: the 2% rule and the swales that make it work

The grading plan is where stormwater becomes landscape design. Oakville’s residential infill standards set three numbers. Yard surfaces must slope at least 2% so water actually moves. No slope can exceed 3:1 anywhere on the lot. Rear yards stay gentler — about 5% maximum — for a 5 m apron behind the house. On rear-to-front lots, an apron swale collects the back yard. Side-yard swales then walk the water around the house to the street — never across the property line.

Two certifications close the loop at final inspection: a grading certification and, where you installed a system, a stormwater device certification. An Ontario Land Surveyor or a professional engineer signs each one. Until they are in, your file stays open and your deposit stays with the Town. By this stage, a season of construction traffic has usually flattened a swale or two. Budget for touch-up grading before the survey crew arrives.

When Conservation Halton joins the table

Does your lot back onto Sixteen Mile Creek, Bronte Creek, a tributary, a valley slope or the shoreline? Then part of it likely sits in an area regulated under O. Reg. 41/24. The regulated band typically runs 15 to 30 m back from the stable top of bank or floodplain. Inside it, construction, grading or site alteration needs a separate Conservation Halton permit. A Town building permit does not stand in for it. The right move is a pre-consultation with CH before you finalize the design, not after. The buffer can shift the buildable envelope in ways zoning numbers alone never show.

What it means for your budget and schedule

  • Design: a civil engineer prepares the stamped servicing, grading and drainage plan. The package includes the stormwater brief the Town requires with your permit application.
  • Testing: order the geotechnical/percolation investigation early — ideally before you finalize the offer. It tells you whether you own a $12,000 system or a $30,000 one.
  • Space: the system needs real estate. On tight lots the gallery ends up under the front lawn or driveway. It also cannot sit within the tree protection zones covered in our tree guide.
  • Schedule: plan the install alongside the other underground work. Protect the finished grades during construction — or pay to rebuild them at certification time.

Grading and stormwater is one line in a much longer budget. On an established Oakville lot, the site costs as a whole — trees, foundation removal, servicing, grading and the statutory charges — are where two identical-looking properties diverge by $300,000. What is Oakville’s 25 mm stormwater rule?

The Town’s development engineering guidelines require you to retain a 25 mm rain event — roughly the first inch — on site, across all surfaces. Most builds do this with a soakaway pit, dry well or infiltration trench. A professional engineer designs the system.

Do rain barrels count toward the requirement?

Who signs off on the lot grading at the end?

An Ontario Land Surveyor or professional engineer certifies the final grading when you request final inspection. The same applies to the stormwater device where you installed one. The Town holds your securities until it accepts the certifications.
